Terms of Service

The rules for using PageFork's website and services.

Last updated

These Terms of Service (“Terms”) govern your use of PageFork’s services, including our marketing site at pagefork.ai, the application at app.pagefork.ai, the sites you publish with it, and any related products or support (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Who we are

PageFork is provided by a sole proprietor (egyéni vállalkozó) registered in Hungary, EU VAT number HU92463251 (“we,” “us,” or “our”). Email: support@pagefork.ai. The seller’s full name and address appear on every invoice and are sent on request to the same address.

Consumers and businesses

These Terms apply whether you use the Service as a consumer or for your business. If you are a consumer, nothing in these Terms limits the rights you have under the mandatory consumer protection law of the country where you live.

Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Accounts and registration

You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us at support@pagefork.ai of any unauthorized use.

License to use the Service

Subject to these Terms and your payment of applicable fees, we grant you a non-exclusive, non-transferable, revocable license to access and use the Service in accordance with your plan and our documentation. We reserve all rights not expressly granted.

Your content and published sites

You retain ownership of content you submit to the Service (“User Content”). You grant us a worldwide, non-exclusive license to host, process, copy, display, and distribute User Content solely to provide, secure, and improve the Service. You represent that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights or applicable law.

You are responsible for the sites you publish with the Service and for what they say, sell or collect. Sites on the Basic plan show a “Built with PageFork” footer; Pro removes it.

Leads and personal data you collect

The Service lets you collect and manage personal data about other people: visitors who submit your forms or view your published sites, and leads you add, import or receive through integrations (“Customer Personal Data”). For Customer Personal Data you are the controller and we process it on your behalf, under the Data processing terms below and as described in our Privacy Policy. You are responsible for:

  • Having a lawful basis to collect and use Customer Personal Data, and giving the people concerned any notice the law requires, for example through a privacy notice on your own site;
  • Obtaining any consent required before you add people to mailing lists, send them marketing, or move their data to other tools, including when a destination fires on a pipeline stage rather than on a form submission;
  • Responding to requests from those people to access, correct or erase their data, using the tools the Service provides;
  • Not using forms or leads to collect special categories of data, payment card numbers, or government identifiers unless the law allows it and you have the safeguards it requires.

Integrations and API keys

You can connect the Service to third-party tools such as Google Sheets, Kit, Mailchimp, Zapier, Make and webhooks you control. When you set up a destination or create an API key, you instruct us to send the data you selected to that tool. We are not responsible for how a third-party tool handles data after we deliver it, or for its availability; your use of it is governed by its own terms.

API keys act on behalf of your team. Keep them confidential, share them only with the tools you connect, and revoke any key you believe has been exposed. You are responsible for activity carried out with your keys until you revoke them.

AI outputs

The Service may generate text, images, layout, and other materials using artificial intelligence. You are responsible for reviewing outputs before use in production or for regulated purposes. AI can produce errors or inappropriate content. We do not warrant that outputs are accurate, non-infringing, or fit for a particular purpose. Do not use the Service in a way that could cause harm, discrimination, or illegal activity.

Acceptable use

You agree not to:

  • Violate any law, third-party right, or our Privacy Policy;
  • Attempt to access non-public areas of the Service, other users’ data, or our systems without authorization;
  • Introduce malware, probe or stress systems without written permission, or interfere with the Service’s operation;
  • Use the Service to build or distribute illegal, fraudulent, hateful, or dangerous content, or to impersonate others;
  • Scrape, resell, or redistribute the Service or its outputs in bulk outside permitted use, or use the Service to train competing machine-learning models without our consent;
  • Reverse engineer the Service except where such restriction is prohibited by law.

If a site or account breaks this section, we may unpublish the site, restrict features, or suspend the account. We tell you what we restricted and why, unless the law or an ongoing investigation prevents it, and you can reply to that notice to contest the decision.

Reporting illegal content

Anyone can report a site published with PageFork that they believe contains illegal content. Email support@pagefork.ai with the address of the page, an explanation of why the content is illegal, your name and email address (unless the report concerns child sexual abuse material), and a statement that the report is accurate and complete to the best of your knowledge. We confirm receipt, review the report diligently and without undue delay, and tell you what we decided. This address is also our single point of contact for authorities and for users under the EU Digital Services Act; we accept messages in English and Hungarian.

Plans, credits and payment

Prices are shown in euros and include VAT where VAT applies. Payments are processed by Stripe; we issue an invoice for every payment.

Site plans

Publishing a site requires a Basic or Pro plan for that site, billed monthly or yearly. Plans renew automatically at the end of each period and we charge the card on file until you cancel. Every new site starts with a 14-day Pro trial, which costs nothing and ends on its own; at the end of the trial the site keeps the plan you chose, or has none.

  • Upgrades apply immediately, and we charge the prorated difference for the rest of the current period.
  • Downgrades take effect at the end of the current period.
  • Cancelling stops the next renewal. The site stays live until the end of the period you paid for; after that it is unpublished and its custom domain is released. Your site, its versions, leads and media are kept.
  • If a renewal payment fails and is not resolved, the site may move to a lower plan or its plan may end.

Credits

AI features use credits, which you buy in packs. Credits do not expire, are shared by your team, and have no cash value except as described in Refunds and your right to withdraw. Credits used by a generation that fails are credited back automatically.

If you turn on auto top-up, you authorize us to charge your saved card for the pack you chose whenever your balance falls below the threshold you set, at most twice per calendar month, until you turn it off.

Price changes

We may change prices for plans and credit packs. For an existing plan, we email you at least 30 days before a new price applies to your next renewal; you can cancel before then to avoid it. Credits you already bought are not affected.

Refunds and your right to withdraw

These refunds apply to everyone, whether you are a consumer or a business.

  • Site plans. Within 14 days of paying for a new plan, an upgrade, or a yearly renewal, you can ask for that payment back. We refund it in full and undo it: a new plan or yearly renewal ends and the site is unpublished, and an upgrade returns the site to its previous plan. If we have already refunded a plan payment for the same site, we refund the unused part of the period instead. Monthly renewals are not refunded; cancel any time to stop the next one.
  • Credit packs. Within 14 days of buying a pack, by hand or through auto top-up, you can ask for a refund of the credits you have not used. We refund the credits still in your balance, up to the size of that pack, at the price per credit you paid for it, and remove them from your balance. Credits you have already used are not refunded.

After 14 days, payments are non-refundable, except where these Terms or the law say otherwise.

To ask for a refund, email support@pagefork.ai from your account’s email address with the site or invoice it concerns, or send us the model withdrawal form. We refund to the original payment method within 14 days of receiving your request and issue a corrective invoice.

Right of withdrawal for consumers

If you are a consumer in the European Union, you have the legal right to withdraw from a purchase within 14 days without giving any reason. The refunds above give you at least that. When you buy credits, you ask us to deliver them immediately and you acknowledge that you lose the right of withdrawal for credits once you use them. When you buy a plan, you ask us to start the service immediately; if you withdraw, we refund as described above.

Our intellectual property

The Service, including its software, designs, and branding, is owned by us and our licensors. Except for the rights expressly granted in these Terms, no rights are transferred to you.

Third-party services

The Service may link to or integrate with third parties (e.g. analytics, payments, AI providers, or the integrations you connect). Your use of those services is subject to their terms and privacy policies.

Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. If you are a consumer, this does not affect your statutory rights where the Service does not conform to the contract.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

Nothing in these Terms excludes or limits our liability for damage caused intentionally or by gross negligence, for damage to life, physical integrity or health, or for any other liability that cannot be excluded or limited by law.

Indemnity

If you use the Service for your business, you will defend, indemnify, and hold harmless us and our affiliates from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your breach of these Terms.

Termination

You may stop using the Service at any time, cancel your plans, and delete your account from your account settings.

We may suspend or terminate your access immediately for a serious breach of these Terms, for non-payment, or where the law requires it. We may also stop providing the Service to you for other legitimate reasons with at least 30 days’ notice by email; in that case we refund the unused part of any plan period you have paid for and the credits left in your balance. Provisions that by their nature should survive (e.g. disclaimers, limitations, indemnity) will survive termination.

Governing law and disputes

These Terms are governed by the laws of Hungary, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you use the Service for your business, the courts competent for our registered seat have exclusive jurisdiction over disputes. If you are a consumer, you keep the protection of the mandatory law of the country where you live, and you may bring proceedings in the courts of that country.

Please send complaints to support@pagefork.ai; we reply in writing within 30 days. Consumers may also turn to the consumer protection authorities, and consumers in Hungary to the conciliation board (békéltető testület) competent for their place of residence or for our registered seat.

Changes to the Terms

We may modify these Terms by posting an updated version on this page. For material changes, we email account holders at least 30 days before they take effect. If you do not agree, you can cancel your plans and close your account before then, and we refund the unused part of any plan period you have paid for. Continued use after the effective date constitutes acceptance of the revised Terms.

Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Service and supersede prior agreements on this subject. If a provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets, and we will tell you if we do.

Data processing terms

This section is our data processing agreement under Article 28 of the GDPR. It applies automatically to Customer Personal Data; you don’t need to sign anything. If you need a countersigned copy, email support@pagefork.ai.

  • Subject and duration. We process Customer Personal Data to provide the Service to you, for as long as you use it and until it is deleted under these terms.
  • Data and people. Contact details, form answers, notes, tags, custom fields, pipeline activity and similar data about your site visitors, form respondents, leads and contacts, and the cookieless visit statistics described in our Privacy Policy.
  • Instructions. We process Customer Personal Data only on your documented instructions, which are these Terms and the settings you choose in the Service, unless the law requires otherwise; in that case we tell you first unless the law forbids it.
  • Confidentiality and security. Everyone we authorize to process Customer Personal Data is bound by confidentiality. We maintain technical and organizational measures appropriate to the risk, including encryption in transit, encryption of stored credentials, access controls and backups.
  • Subprocessors. You authorize the subprocessors listed in our Privacy Policy. We announce changes by updating that list, and you can object by emailing us. We bind each subprocessor to data protection obligations equivalent to these, and we remain responsible for them.
  • Transfers. Where Customer Personal Data leaves the European Economic Area, we rely on an adequacy decision, such as the EU-U.S. Data Privacy Framework, or on the EU Standard Contractual Clauses.
  • Assistance. We help you respond to requests from the people concerned, mainly through the export, correction and erasure tools in the Service, and with security, impact assessments and consultations with supervisory authorities where relevant.
  • Breaches. We notify you without undue delay after becoming aware of a personal data breach affecting Customer Personal Data, with the information you need to meet your own obligations.
  • Deletion. You can export Customer Personal Data at any time. When you delete it, or delete your team or account, we delete it from the live systems; copies in backups are overwritten in the normal backup cycle.
  • Audits. We make available the information necessary to demonstrate compliance with this section and allow for and contribute to reasonable audits, on reasonable notice and at most once a year unless a supervisory authority requires otherwise.
